Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you and Cinder Marketing LLC ("we," "us," or "our"), concerning your access to and use of the honestwatts.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Service.
Credit Report Authorization and Fair Credit Reporting Act (FCRA) Disclosure
By agreeing to these terms, you authorize Honest Watts and its partners to obtain consumer reports, which may include credit reports, for verification purposes and to determine your eligibility for solar financing options, including zero-down solar programs.
Important Information About Credit Checks:
Soft Credit Pull: We only perform soft credit inquiries, which do not affect your credit score.
Verification Purpose: Credit information is used solely to verify your identity and assess qualification for solar financing programs.
No Storage or Sharing: We do not store, save, display, or share your credit score or detailed credit information with any third parties beyond what is necessary for solar financing qualification.
Temporary Use: Credit information is accessed only for the immediate purpose of qualification assessment and is not retained in our systems.
Optional Process: Credit verification is optional and not required for receiving solar quotes or estimates.
Your Rights Under the FCRA:
Under the Fair Credit Reporting Act (FCRA), you have certain rights regarding consumer reports. You have the right to:
Know when information in your file has been used against you
Know what is in your file
Ask for your credit score
Dispute incomplete or inaccurate information
Limit access to your file
Seek damages from violators

SMS Communications Terms
By providing your phone number to Honest Watts, you agree to the following terms and conditions:
Honest Watts SMS Communications:
Limited Use: Honest Watts will only send you SMS messages for phone number verification purposes during the quote request process.
Verification Codes Only: You will receive a one-time verification code to confirm your phone number. No other marketing or promotional messages will be sent by Honest Watts.
Message Frequency: You may receive up to 2 verification messages per quote request.
Opt-Out: You may opt out of receiving SMS messages at any time by replying STOP to any message we send you.
Third-Party Solar Installer Communications:
Important: After completing your quote request, you may receive separate communications (including phone calls, text messages, and emails) from qualified solar installers and representatives who will contact you directly to discuss your solar options. These communications are sent by third-party solar companies and installers, not by Honest Watts.
Separate Communications: Solar installers may contact you via phone, SMS, or email to provide quotes, schedule consultations, and discuss solar installation options.
Third-Party Responsibility: These communications are managed independently by each solar installer and are subject to their own terms of service and privacy policies.
Contact Preferences: If you wish to stop receiving communications from a specific solar installer, you must contact them directly using their provided opt-out methods.
General SMS Terms:

Help Instructions: Text HELP to any Honest Watts verification message to get information about the SMS verification process.
Costs: Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
By providing your consent to participate in this program, you are agreeing to these terms and conditions, our Privacy Policy, and those terms required by your wireless carrier for SMS messaging.
Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions.
User Representations
By using the Site, you represent and warrant that:
All registration information you submit will be true, accurate, current, and complete;
You will maintain the accuracy of such information and promptly update such registration information as necessary;
You have the legal capacity and you agree to comply with these Terms of Service;
You are not a minor in the jurisdiction in which you reside;
You will not use the Site for any illegal or unauthorized purpose;
Your use of the Site will not violate any applicable law or regulation.
Governing Law
These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the state where Cinder Marketing LLC is established, without regard to its conflict of law principles.
